Type of data processed and purpose of processing

No personal data of any kind is requested for browsing the website.

If the user interacts by purchasing a product, subscribing to the newsletter or filling in the contact form, the following data will be requested:

Product purchase: to purchase a product, the user must register with a username and password, for which he/she is asked to fill in the following fields: name, surname, gender, date of birth, e-mail and postal address. All of them are identification data in order to manage the purchase and any claims or queries that may arise during the purchase.

Subscription to the newsletter: in order for the user to receive the appropriate communications, an e-mail address is requested. This data is considered identifying data.

Contact form: in order to resolve the user's doubts, queries and/or complaints, in the contact section of the website, the user's e-mail address is requested in order to contact him/her and attend to his/her request.

All data provided by the user will become part of the data processing, created and maintained under the responsibility of Capitan Denim, essential for the purposes described above. Profiles of users from whom data is collected are not created.

Legitimation of the processing

Contract or pre-contract (art 6.1 b) RGPD): if you make a purchase through our website, we will ask you to fill in the form in order to manage your data in relation to the purchase.

Legitimate interest (art. 6.1 f) RGPD): to respond to requests sent through the contact form and to manage the collection of amounts owed. Consent of the data subject (art 6.1 a) RGPD): in order to send you information from our newsletter and provided that you authorise us by ticking the acceptance box in the privacy policy.

Data security

The Capitán Denim website has the LSSI-CE certificate for secure browsing so that personal data (credit card, address...) are private when sent via this website.

Internally, Capitan Denim has the necessary security measures in place (firewall, antivirus, updated software, etc.) to prevent a security breach and unauthorised third parties gaining access to data.

Transfer of data to third parties and international transfer of data.

We transfer your data to third party organisations that manage the sending of newsletters, the sending and management of your purchases and to Google Inc. in the case of acceptance of Google Analytics cookies. In other cases, we do not disclose data to third parties except to comply with the legal obligations to which we are subject. In the event that we have to disclose your data, we will request your express, written consent prior to such disclosure, informing you at all times of the purpose of such disclosure.

We do not transfer data internationally.

Retention of data

Your personal data will be kept for the time necessary to achieve the purposes described above. Once they have fulfilled their purpose, they will be blocked to prevent their processing until the expiry of the legal deadlines to which we are subject. In this case, they may only be processed by Public Administrations, Judges and Courts. After the legal deadlines have expired, the data will be destroyed.

Rights of data subjects

Pursuant to art. 15-22 GDPR you can exercise the following rights as a data subject:

Right of access in order to know what data is being processed.

Right of rectification in case your data is not accurate and real.

Right of erasure when you decide that your data should be deleted because you have terminated your relationship with us and provided that there is no legal imperative that allows its processing.

Right of restriction where the processing exceeds the minimum necessary data required for the processing. The right to object if you do not want us to process your data. We will stop processing your data except where we have a legitimate interest.

The right to data portability where the legal basis is a contractual relationship or consent.
