Identity of the contracting parties

Object of the contract

The purpose of this contract is to regulate the contractual sales relationship between Capitan Denim and the purchaser, which involves the delivery, in exchange for a specific price, of a specific product.

Contracting procedure

In order to access the services or products offered by Capitan Denim, the purchaser must register on the website by creating an account. 6. Delivery

Unless there are circumstances arising from the personalisation of the products, or unforeseen or extraordinary circumstances occur, we will send you the order within the period indicated on the website. If for any reason we are unable to meet the delivery date, we will inform you of this circumstance and give you the option of either proceeding with the purchase by setting a new delivery date or cancelling the order with a full refund of the price paid. Please note, however, that we do not deliver to your home on public holidays, Saturdays or Sundays.

If we are unable to deliver your order, we will try to find a safe place to drop it off. If we are unable to find a safe place, your order will be returned to our warehouse and we will leave you a note explaining where your order is and how to arrange for it to be re-delivered to you. If, 15 days after your order has been available for delivery, the order has not been delivered for reasons not attributable to us, we will understand that you wish to withdraw from the contract and we will consider it terminated.

7. Right of withdrawal

The buyer has the right to withdraw from this purchase contract within 14 calendar days without giving any reason. In order to exercise the right of withdrawal, you must notify us of your decision to withdraw from the contract by means of an unequivocal statement (e.g. a letter sent by post or e-mail).

In the event of withdrawal by the buyer, we will reimburse to him all payments received, including the costs of delivery (with the exception of the additional costs resulting from his choice of a delivery method other than the least expensive standard delivery method offered by us) without undue delay and in any event not later than 14 calendar days from the date on which we are informed of your decision to withdraw from this contract. We will proceed to effect such reimbursement using the same means of payment used for the initial transaction. You will not incur any charges as a result of the refund. Notwithstanding the foregoing, we may withhold reimbursement until we have received the goods and found them to be in good condition. You will not have the right to withdraw from the contract under the following conditions:

Defective items, whose defect has been caused by misuse or any cause not attributable to Captain Denim.

Your right to withdraw from the contract shall apply only to those products that are returned in the same condition in which they were received. No refund will be made if the product has been used beyond the mere opening of the product, products that are not in the same condition in which they were delivered or have suffered any damage, so you should be careful with the product/s while they are in your possession. Please return the item(s) using or including all original packaging, instructions and any accompanying documents.
